1. Acceptance of Terms
By accessing or using InwrdsGolf ("the Service"), operated by Chase Pochylko ("we," "us," "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
InwrdsGolf is a golf performance analytics platform that provides strokes gained analysis, practice priority generation, and practice session tracking. The Service is currently offered as a free beta.
3. User Accounts
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose.
- Attempt to gain unauthorized access to the Service or its systems.
- Interfere with or disrupt the integrity or performance of the Service.
- Upload malicious code, viruses, or harmful content.
- Scrape, crawl, or use automated means to access the Service without permission.
- Impersonate another person or entity.
5. Intellectual Property
All content, features, and functionality of the Service, including but not limited to text, graphics, logos, algorithms, and software, are owned by InwrdsGolf and are protected by Canadian and international intellectual property laws. You retain ownership of the golf performance data you submit to the Service.
6. AI and Coaching Disclaimer
The Service uses artificial intelligence to analyze golf performance data and generate practice recommendations. These recommendations are for educational and informational purposes only. They do not constitute professional golf coaching, medical advice, or fitness instruction. Results may vary, and no specific performance improvement is guaranteed. 7. Beta Service
The Service is currently in beta. Features may change, be removed, or become unavailable without notice. We provide the Service "as is" during the beta period and make no guarantees regarding uptime, data preservation, or feature availability. We will make reasonable efforts to notify users of significant changes.
8. Subscription Terms
The Service is currently free during the beta period. If paid subscriptions are introduced in the future, we will provide notice and separate subscription terms. You will not be charged without explicit consent.
9. Limitation of Liability
To the fullest extent permitted by applicable law, InwrdsGolf and its founder shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service. Our total aggregate liability shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or CAD $100, whichever is greater.
10. Indemnification
You agree to indemnify and hold harmless InwrdsGolf, its founder, and affiliates from any claims, damages, losses, liabilities, and expenses arising out of or related to your use of the Service or violation of these Terms.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. You may request deletion of your data by contacting us.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Province of Saskatchewan and the federal laws of Canada applicable therein. Any disputes arising under these Terms shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts of Saskatchewan, Canada.
13. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated by posting the revised Terms and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance.
